Hiring Terms and Conditions

1. Booking & Payment

  • The Hirer is to pay the fee and/or bond shown on the quote within 28 days of booking and at least 7 days before the booking date to secure the hall.
  • The security bond will be returned up to 14 working days after the event, provided:
    • all Terms and Conditions are adhered to
    • the key has been returned
    • no damage is reported
    • final invoice paid

2. Use of Facility

  • Use of the hired areas (including set-up, pack-up and cleaning) is limited to the booked hours.
  • Sufficient time must be included within the booking for all set-up and cleaning.
  • Use of the facility outside booked times:
    • is a breach of this agreement
    • will incur additional charges

3. Smoking Requirements

  • Smoking is not permitted:
    • inside the hall
    • in playground areas
  • Smoking outside must occur:
    • at least 10 metres from doors and windows
    • in a way that prevents smoke entering the building

4. Cleaning & Waste Removal

The Hirer must leave the premises clean and tidy, including:

  • sweeping and mopping floors
  • wiping down furniture
  • cleaning kitchen areas (if applicable), including:
    • bench tops and stove
    • dishwasher
    • removing all food from fridge/freezer

Waste requirements:

  • all rubbish and bottles must be removed unless a waste levy has been paid
  • excess rubbish must be taken away by the Hirer at their own cost

5. Equipment & Set-Up

  • The Hirer is responsible for:
    • setting up and packing away tables and chairs
    • returning all items to their original location

6. Event Accuracy

  • Hirers must accurately describe the nature of their event.
  • Misrepresentation may result in:
    • cancellation of booking
    • forfeiture of bond

7. Security of Premises

  • The Hirer must:
    • turn off all lights
    • secure all doors and windows
  • DeafCare reserves the right to recover costs where damage or loss occurs due to failure to secure the facility.

8. Damage, Cleaning Costs & Bond

  • The Hirer must pay for any damage to:
    • the premises
    • fixtures, fittings or equipment
  • Costs will be:
    • deducted from the bond
    • invoiced if exceeding the bond amount
  • Hirers are encouraged to take before and after photos.

9. Keys & Access

  • Access instructions must not be shared with third parties.
  • Keys must be returned on the next business day.
  • Lost keys will result in charges for:
    • replacement
    • lock changes (if required)

10. Personal Property

  • The Hirer is responsible for all personal property brought into the facility.
  • DeafCare accepts no responsibility for loss or damage.

11. Grounds & Surroundings

  • The Hirer is responsible for:
    • cleaning surrounding grounds and gardens
    • removing all event-related waste

12. Conduct & Legal Compliance

  • The Hirer must ensure:
    • no illegal activities occur
    • all guests behave safely
  • The Hirer is responsible for any costs arising from unlawful behaviour.

13. Third Party Injury or Damage

  • The Hirer accepts responsibility for injury or damage to third parties caused by:
    • their actions
    • their guests’ actions

14. Cancellations

  • Less than 48 hours’ notice: no refund
  • 48 hours to 1 week: 50% refund
  • 1 to 2 weeks: 75% refund

15. Incident Reporting

  • All hazards or incidents must be reported to:
    • bookings@deafcare.org.au

16. Breach & Termination

  • DeafCare may terminate the agreement if any terms are breached.
  • The Hirer must vacate immediately if requested.

17. Bond Recovery

  • DeafCare may apply the bond to cover any breach.
  • Any additional costs must be paid by the Hirer.

18. Insurance, Waiver & Indemnity

18.1 Insurance Requirement

  • The Hirer must hold Public Liability Insurance of at least $10,000,000.
  • A Certificate of Currency must be provided before the event.

18.2 Hirers Without Insurance

If the Hirer does not hold Public Liability Insurance:

  • DeafCare may allow the booking at its discretion for low-risk activities only
  • The Hirer:
    • acknowledges they are uninsured
    • accepts personal liability for any claims
    • agrees to the terms below
  • DeafCare may refuse or cancel bookings it considers higher risk

18.3 Assumption of Risk

  • The Hirer acknowledges that use of the hall involves risks, including:
    • personal injury
    • property loss or damage
  • The Hirer accepts responsibility for all attendees.

18.4 Indemnity

  • The Hirer agrees to indemnify and hold harmless DeafCare and its:
    • officers
    • volunteers

from any:

  • claims
  • losses
  • damages
  • legal costs arising from:
  • the use of the facility
  • actions of the Hirer or their guests

18.5 Limitation of Liability

  • Nothing in this agreement excludes liability where it cannot legally be excluded.
  • Otherwise, DeafCare is not liable for:
    • injury
    • loss
    • damage

arising from the Hirer’s use of the facility.

NO ALCOHOL:

There is a strict no smoking policy for all Hall facilities (including kitchen and bathrooms).

 

No alcohol is to be brought onto or consumed on the premises or the immediate surroundings including the car parks.
